The Patent Trial and Appeal Board ruled that tribal sovereign immunity does not apply to inter partes reviews and dismissed a motion to toss generics companies' challenges to patents. A panel of three administrative patent judges unanimously ruled there is no controlling precedent or statutory basis for the application of tribal immunity in inter partes review proceedings and found the drugmaker is effectively still the patent owner.
