Brandon White’s practice focuses on pharmaceutical patent and regulatory litigation under the Hatch-Waxman Act and U.S. Patent and Trademark Office post-grant proceedings. He represents some of the largest generic pharmaceutical companies in complex and legally significant pharmaceutical patent cases.
Brandon recently first-chaired a trial victory in a case challenging a patent on Zytiga® and argued the successful corresponding inter partes review (IPR). Brandon and his team also recently invalidated patents alleged to cover Copaxone® in a trial in Delaware and in three separate IPR proceedings, all of which were affirmed on appeal. He has handle cases relating to glatiramer acetate, rasagiline, esomeprazole, rosuvastatin, cyclosporine, fingolimod and levofloxacin, among many others.
In another recent noteworthy win, Brandon was part of the team that defended against an attempt to use tribal sovereign immunity to shield patents from IPR review. The firm’s work on that matter was awarded the LMG Life Sciences “Impact Case of the Year Award.”
In addition to his experience in the federal district courts and in the U.S. Court of Appeals for the Federal Circuit, Brandon has extensive experience in IPR proceedings that often accompany Hatch-Waxman cases. He helped secure the first generic-side win in an IPR, challenging a formulation patent on the multiple sclerosis drug Gilenya®, and has secured other key victories, including in IPRs related to patents on Copaxone® and Zytiga®.
In addition to his U.S. practice, Brandon is experienced across the globe, helping his clients litigate cases in foreign tribunals around the world. He has extensive experience in the European and Indian Patent Offices, and he has helped his clients with trials throughout Europe, Canada and India.
Outside of the pharmaceutical space, Brandon frequently handles cases related to other technologies. He has extensive experience in cases brought in the United States International Trade Commission covering a wide variety of technological areas, including welding equipment, mobile communications and networks, check processing, white goods, data encryption, sporting goods and equipment, consumer electronics, medical devices and pharmaceuticals.
Prior to attending law school, Brandon had a successful career as a structural engineer in Cleveland, Ohio.
