Dan Bagatell was quoted in “4 Proposed Fed. Circ. Rule Changes Attorneys Should Know,” an article in Law360,* regarding key changes attorneys should be aware of when practicing at the Federal Circuit going forward.

Federal Circuit judges have expressed concern when attorneys bring up a case for the first time at oral argument, but the court had not previously had a rule that parties must notify opposing counsel before doing so, said Dan Bagatell.

"Otherwise, it's a little unfair. You get up there, the other side cites a case, and you have no idea what they're talking about," he said.
