Michelle Umberger, operating out of the Madison, WI office, advises TTOs to always retain an independent expert to confirm infringement prior to taking any legal action. “Do no rely solely on internal analysis,” she says. “Whether or not you end up using that individual as your testifying expert, you need someone who is independent of the conception and development of the invention as well as the parties involved.”
