Overview

Jonathan Gross advises companies on issues relating to technology, privacy, data security, consumer protection, e-commerce, social media, and the Internet of Things (IoT). Jonathan partners with clients to assess their information and data usage practices and develop privacy and data protection programs that comply with international and domestic laws and regulations, including the Telephone Consumer Protection Act (TCPA), California Consumer Privacy Act (CCPA), California Privacy Rights Act (CPRA), General Data Protection Regulation (GDPR), Health Insurance Portability and Accountability Act (HIPAA), Health Information Technology for Economic and Clinical Health (HITECH), and U.S. Federal Trade Commission (FTC) regulations.

Jonathan drafts consumer-facing policies and notices, including terms of service, privacy policies, and end user agreements, and counsels on technology, privacy, and data security aspects of mergers and acquisitions and capital markets matters. He also negotiates intellectual property licensing, technology, and other commercial agreements, including master services agreements (MSAs), general terms and conditions (GTCs) and data processing agreements (DPAs), and advises on trademark, copyright, and other intellectual property matters.

A former in-house counsel in Silicon Valley, Jonathan has significant experience providing intellectual property, product, privacy, and cybersecurity counsel from multiple vantage points. His experience includes advising legal, product, engineering, marketing, and security teams on Privacy by Design principles for product launches and new data usage initiatives, implementing privacy and data protection programs, conducting data mapping and privacy impact assessments, and counseling on cross-border transfers. He also has experience advising on data breach and breach preparation matters, including drafting companywide and department-specific incident response plans (IRPs), conducting trainings, and security tabletop exercises.

As the former head of product and privacy for a unicorn technology startup, and former senior counsel for a global, European technology company, Jonathan has valuable and pragmatic insight into assessing risk, implementing data protection programs and processes, and negotiating technology transactions.
