Scott Palmer was quoted in "GC Agenda China: February 2023," an article in Thomson Reuters Practical Law Chinaaddressing the circulation of the Trademark Law of the People’s Republic of China for comments.

 

The breadth and depth of the changes contemplated to trademark law and practice in this new draft are nothing short of astounding, and they reflect an ambitious attempt by the CNIPA working group to address a number of new and long standing issues. While we are only at the beginning of the amendment process, I certainly wouldn't be surprised if some of the more significant draft changes contemplated to make it to the finish line (nobody really knows when) with only minor tweaks, such as the stand-alone basis for clearing applications and registrations of trademark that were filed in bad faith, a mechanism for the transfer of challenged trademarks in invalidation petitions, a more robust and potentially troublesome prohibition on the duplicate registrations, and a trademark use requirement for the maintenance of trademark registrations.
