Press Releases

CHICAGO (April 15, 2019) - Perkins Coie is proud to announce that a new guidebook on the fight against global corruption and graft, edited by firm partner T. Markus Funk, has been published by Oxford University Press. Markus’ co-editor is Andrew S. Boutros.

As the fight against corruption goes global, practitioners in the compliance, regulatory, and investigative space must understand—and, more importantly, navigate—these increasingly complicated and often perilous compliance waters. The first-of-its-kind book, “From Baksheesh to Bribery, Understanding the Global Fight Against Corruption and Graft,” draws on the real-world experience and expertise possessed by some of the world's leading anti-corruption and anti-bribery practitioners to make meeting that challenge easier.

"While the U.S. Foreign Corrupt Practices Act (FCPA) continues to be a critical anti-bribery instrument, the emergence of other nations’ updated anti-corruption legal regimes and significantly enhanced enforcement approaches signal that it is high time to start thinking beyond the FCPA. I am grateful to Oxford Press and to our contributors for having created this uniquely comprehensive contribution to a never-more-topical discussion," said T. Markus Funk, the chair of Perkins Coie’s White Collar & Investigations practice.

As evidenced by the FCPA, the U.K. Bribery Act and Chinese, French, Indonesian, Brazilian and German anti-bribery legislation, anti-corruption efforts are an increasingly important part of the law reform and enforcement agendas. Featuring country-specific chapters and practitioner-focused "how to" modules, this book is a comprehensive guide for practitioners, in-house counsel, compliance personnel, academics and others required to understand the world's perspective on corruption—and the fight against it.

Markus is the firmwide chair of Perkins Coie’s White Collar & Investigations practice. Prior to joining the firm, Markus served as a decorated federal prosecutor in Chicago, section chief with the U.S. State Department—Balkans, clerk with the federal court of appeals and district court and law professor at Oxford University and the University of Chicago. He teaches a law school class on the FCPA, and since 2010, he has served as the founding co-chair of the ABA’s Global Anti-Corruption Committee. Institutions as diverse as the U.S. Senate, the Vatican, Harvard Law School, Yale Law School, the New York Mayor’s Office and the World Bank Group have invited Markus to speak on cutting-edge compliance, litigation and internal investigation issues. Markus has also penned hundreds of law-related articles and book chapters, as well as eight books, including The ABA Compliance Officer’s Deskbook (American Bar Association, 2017) and Mutual Legal Assistance Treaties and Letters Rogatory: A Guide for Judges (Federal Judicial Center, 2014).

Praise for the book:

"The unique breadth of From Baksheesh to Bribery deserves praise. It represents the deepest dive to date into the complex and ever evolving world of anti-corruption laws and policies. Congratulations to the authors for having put such a puzzle together!"

—Nicola Bonucci, Director of Legal Affairs and Accession Coordinator, Organization for Economic Co-operation and Development (OECD)

"This book stands apart in that it offers critical aid to world leaders and their staff engaging in the necessary comparative study of anti-corruption laws. It is my fervent hope that this book will change the narrative and shift the corporate calculation characterizing the fight against corrupt influence and bribery."

—Leonard McCarthy, World Bank Group Integrity Vice President (2008 - 2017)

"The authors, both global practitioners in the field of corporate compliance, have assembled an exceptionally comprehensive survey. This book will surely help judges, practitioners, business people, legislators, and others understand why corruption—and the fight against it—have become truly global phenomena."

—Virginia M. Kendall, U.S. District Judge (Chicago)

"Funk, Boutros, and their contributors truly elevate the game with expert guidance in key compliance and investigation-related topics practitioners grapple with in their day-to-day work. The authors have made a significant contribution to the anti-corruption field that should prove to be an invaluable and practical resource for years to come."

"This book is an essential guide on the global fight against corruption."

—Marsha McClellan, Associate General Counsel, BMO Financial Group

"At last, a book that takes anti-corruption scholarship to a higher level beyond the typical focus on the FCPA and UK Bribery Act. From country and region-specific analysis, to in-depth chapters on important topics such as sensitive internal investigations, third party diligence and transnational investigations, there is something here for everyone. As anti-corruption thinking matures, this book will keep you at the forefront of this important topic."

—Richard W. Grime, Former SEC Assistant Director of Enforcement; Partner, Gibson, Dunn & Crutcher LLP

"A comprehensive undertaking by expert practitioners. Funk and Boutros have produced a uniquely helpful guide to understanding and managing the challenges presented by global corruption. A powerful resource for anyone working in the field of compliance."

—Stephen Gottesfeld, Executive Vice President and General Counsel, Newmont Mining Corporation

"A very practical go-to reference for anti-corruption legislation and enforcement in all the key countries (and then some). Simply put, a great resource."
