Perkins Coie Government Contracts attorneys presented a webinar with members of the Association of Corporate Counsel National Capital Region (ACC NCR), “Other Transactions: Recent Developments and Challenges.”

The Department of Defense (DoD) is rapidly increasing its use of Other Transaction Authority (OTA) to carry out prototype, research, and production projects. DoD’s use of prototype OTAs more than tripled to $3.7 billion in FY 2018 from FY 2016. Because Other Transactions (OTs) are not procurement contracts, they create both opportunities and challenges for industry. This presentation focused on emerging developments related to OTs in government acquisition, including the government’s approach to OTs, effective strategies by prime contractors and subcontractors related to OTs, and recent bid protest decisions that raised questions about how (and where) agency decisions related to OT awards may be challenged.
