Overview

In his counsel to government contractors, Seth Locke protects clients’ rights and interests in a range of matters, including bid protests, contract performance issues, cost accounting claims, and other disputes. He advocates before the Civilian Board of Contract Appeals, the U.S. Court of Federal Claims, and the U.S. Government Accountability Office (GAO). Skilled in government contracts litigation, Seth recently secured a substantial win for a major aerospace defense contractor in an arbitration proceeding with its subcontractor under a large government contract.

In addition, Seth counsels clients in transactions such as mergers and acquisitions, helping clients comply with the maze of government regulations and unique M&A issues, such as the novation process, surrounding these deals. Seth has extensive experience with the Federal Acquisition Regulation. Risk management and litigation prevention in the government contracting process are at the core of Seth’s counsel to his clients, who include defense contractors, logistics contractors, global aerospace manufacturers, healthcare contractors, and several technology companies.

Seth has also helped construction contractors navigate the federal landscape. When representing a construction firm under a large U.S. Agency for International Development IDIQ contract to reconstruct Afghanistan’s infrastructure, Seth advised on regulatory compliance with the government and also litigated a subcontractor dispute at international arbitration.

Additional government contracting issues in Seth’s background include False Claims Act cases, contract termination procedures, and internal investigations. A particular practice strength is counseling clients on protecting their rights in technical data and computer software. He has developed a wide-ranging practice serving the government contracting community that includes productive relationships with agencies and key decision-making authorities.

Seth teaches at The George Washington University Law School, his alma mater, as a guest seminar lecturer on Board of Contract Appeals litigation, and he has also taught courses for Federal Publications Seminars and provides a range of continuing legal education presentations for clients. Seth’s pro bono practice includes working with the National Veterans Legal Services Program to assist veterans in submitting claims for combat-related special compensation to the U.S. Department of Defense.
