In the age of “big data,” companies increasingly seek new ways to understand their customers and their behaviors, and to reach them in myriad ways, including online, offline and through their mobile devices. Advances in technology present ever more sophisticated ways to reach present and potential customers. At the same time, regulators and plaintiffs’ attorneys continue to seek to hold companies accountable for alleged violations of privacy laws, and a complex network of self-regulatory principles and organizations has grown up around online and mobile advertising.  The seminar discussed the privacy laws and rules that govern marketing, including the Telephone Consumer Protection Act, CAN-SPAM, the FTC’s new rules for the Children’s Online Privacy Protection Act, point of sale laws, and self-regulatory principles for online and mobile marketing.
