Mica Simpson was quoted in the Law360 article, “Mott Fruit Snack False Labeling Suit Nears Checkout,” regarding the ruling to tentatively dismiss the class action accusing Motts Inc. of misleading consumers.

Motts’ attorney Mica Simpson, who urged Judge Fitzgerald to adopt his tentative ruling, said other court rulings have found no difference between puree and actual fruit.

“There must be some affirmative misrepresentation that the plaintiffs have to hang their hat on,” to survive the motion to dismiss, she said.
