Law360* quoted Marc Martin in an article, "Net Neutrality Ruling Leaves States' Roles Unsettled," regarding states inability to pass their own consumer protection measures pertaining net neutrality.
Marc said the Federal Communications Commission may have trouble advancing its argument for preempting specific state laws, as the Restoring Internet Freedom order ceded direct oversight of Internet Service Providers to the Federal Trade Commission. This will give states ammunition to fight the FCC's claims that their laws run amok of its authority, he said.
"The FCC has asserted it has no statutory authority over broadband services, so where's the conflict? It's not an easy lift," Marc told Law360. "I think Washington, Oregon and California are having a little bit of champagne right now."
