Marc Martin was quoted in “Trump DOJ Picks New Fight Over Net Neutrality,” an article in The Hill, regarding the net neutrality cases and the future of the broadband industry.

Marc Martin, a former FCC staffer, thinks those states could have an uphill battle in court.

“They’re going to spin it as, ‘We’ve still got to protect our residents,’” Marc said in a phone interview. “And there’s a possibility that may work but there’s a lot of precedent for pre-emption.”

Marc said Congress might not make a serious effort at legislation unless there’s an uproar over industry practices after deregulation.

“At some point someone’s going to be tempted to get more aggressive with this freedom that they have to throttle or block websites, and then somebody’s going to get really upset and it’s going to become the rallying call for legislation,” he said.

“But until then, I don’t think it’s going to happen; you need that sort of bloody shirt to wave.”
