Marc Martin was quoted in the Law360* article, "D.C. Circ. Ruling Curtails FCC's 5G Rollout Strategy" regarding the D.C. Circuit ruling that wireless small cell nodes are still subject to certain preconstruction reviews.

“They’re not just going to take hyperbole as a rationale,” Marc said of the court. “As to 5G in particular, it’s just wireless network infrastructure, which has been around for decades. You can try to say this is new and improved, but it’s the same stuff.”

The D.C. Circuit’s decision simply means the FCC can’t hyper-accelerate 5G infrastructure rollout without subjecting small cells to standard impact reviews, according to Marc. “On one level, you could say this restores the status quo of typical deployment,” he said.
