Partner Gene Lee was quoted in “5 Big Developments That Shaped the PTAB in 2020,” an article in Law360*, regarding five critical PTAB developments.

Gene said the decision marks a shift away from the board's focus on following the money— looking at who has control over and is funding a petition.

"The board's current focus on RPI is on who has an interest in and benefits from the IPR in question," Lee said. "And while those two factors are not sufficient by themselves to establish that somebody is an RPI, I think those factors have gained in significance since the early days of PTAB practice."
