Partner Tom Jensen was quoted in “Monument Moves Leave Unresolved Scope of Presidential Power (1),” an article in Bloomberg Law, regarding the president’s authority over monument size under Antiquities Act.
Courts have generally deferred to presidential authority under the Antiquities Act, leading presidents “to do largely as they see fit,” said Tom.
“And so the stakes are high, and the uncertainty is enough to likely keep the battle going for some time,” Tom said.
