Chicago bankruptcy partners David Neff and Eric Walker recently obtained a victory in the United States Court of Appeals for the Ninth Circuit for client LNR Partners in JPMCC 2007-C1 Grasslawn Lodging, LLC v. Transwest Resort Properties, Inc. The appeal involved a complex chapter 11 bankruptcy case from the United States Bankruptcy Court for the District of Arizona, involving two luxury Westin resorts in Tucson, Arizona and Hilton Head, South Carolina. In a 2-1 decision, the Ninth Circuit reversed District Court’s dismissal of LNR’s appeal on equitable mootness grounds, and remanded the case back to the District Court to consider the merits of LNR’s objections to the chapter 11 plan.
