Janis Kestenbaum was quoted in the Law360* article, "FTC's Zoom Deal Signals New Data Security Plan Under Dems," regarding Zoom Video Communications Inc.'s agreement to enhance its data security practices to settle claims that it misled users about its encryption and undermined a browser security setting.

But the Zoom deal also notably featured a pair of dissents by the two Democratic commissioners that provided "a roadmap to the things that Democrats would like to change and probably will try to change" about the way the FTC handles privacy and data security violations in a Biden administration, said Janis, a onetime senior adviser to the agency's last Democratic chair, Edith Ramirez.

"It's likely we'll see Democratic leadership take the authority that the commission currently has and really try to absolutely push it to its limits," Janis said.
