Perkins Coie Partner David Biderman was quoted in a Law360 article titled "FDA's Kind Label Reversal Shows 'Healthy' Standard Is Stale."  The article discusses a recent announcement by the U.S. Food and Drug Administration that it will allow Kind LLC to use the word "healthy" on snack bar labels while the agency rethinks what constitutes a healthy food. "It's basically a retreat, but [FDA officials] want to maintain some consistency with the current regulation on implied nutrient content claims," said David, adding "I think they will allow greater levels of healthy saturated fats. I don't know how they'll define it, but it's ... clear that's the way the science is moving."
