David Biderman was quoted in the Informa Pharma Intelligence article, "COVID-19 Deter Class Actions? No. Plaintiffs' Attorneys Have Time for More Complaints? Yes.," regarding class action complaints led in 2020 against food, dietary supplement, and beverage firms.

Class action complaints led in 2020 against food and beverage companies are on track to reach 200, up from 180 led 2019, says David. The large majority are in federal courts.

In 2020, with three months remaining, 130 class action complaints have been led against supplement, food and beverage companies, up from 179 for 2019, David noted in his presentation slides during a panel discussion on 24 September in a Food and Drug Law Institute conference conducted online. 

He said complaint filings continue “because plaintiffs’ council is not doing as many court appearances, not doing as many depositions, so they have plenty of time to go through and shop and find new cases to bring.” “COVID has had zero effect in diminishing filings,” added David, who specializes in mass tort litigation and consumer class actions, during the conference conducted online.
