Benjamin Sharp was quoted in the Law360 article, "9th Circ. Judge: Tribe ‘Did Nothing’ To Stop Rival Casino," regarding his client's challenge to a tribe casino.
Benjamin represents a citizens group neighboring the Enterprise Rancheria’s new casino. His clients challenged whether the DOI had land trust acquisition authority for the Estom Yumeka Maidu Tribe, arguing that the government had not put forward concrete evidence that the people living on the Enterprise Rancheria met the definition of a “recognized Indian tribe” under the U.S. Supreme Court’s definition in its 2009 Carcieri v. Salazar decision.
“If the secretary is trying to meet the standard of making a decision for a recognized Indian tribe, he has to make a showing of why they’re a recognized Indian tribe,” Benjamin said. “He has not done so here.”
