Counsel for the Arizona Board of Regents in the Arizona Superior Court, the Arizona Court of Appeals, and the Arizona Supreme Court in a suit brought by the Arizona attorney general (AG) in which the AG challenged the legality of the Arizona Board of Regents’ lease to Omni Hotels & Resorts (Omni) for the construction of a hotel and conference center on Arizona State University’s Tempe campus. The Arizona Supreme Court affirmed the dismissal of two of the AG’s claims because he lacked statutory authority to bring them. The court also remanded for further proceedings two other claims that challenge (1) the Arizona Board of Regents’ statutory leasing power and (2) the lease to Omni under the Arizona Constitution’s Gift Clause. __ Ariz. __, __ P.3d __ (2022).
