John Roche was quoted in the Law360 article, “Google Rules Undercut Decency Law Immunity, D.C. Circ. Told,” about an attempt to revive a suit against Google regarding its immunity under the Communications Decency Act (CDA).
John Roche, arguing for Google, said the dispute over the blog in question is exactly the sort of situation Congress envisioned when it passed the CDA in 1996.
Roche conceded that the current online environment is not perfect but said construing the CDA in favor of Bennett would not improve things.
“Believe it or not, it could be worse,” he said.
