Henry Hauser was quoted in “Eleventh Circuit Revives Burger King No-Poach Case,” an article in Global Competition Review,* regarding the U.S. Court of Appeals for the Eleventh Circuit's finding that Burger King and its franchisees are a single economic enterprise incapable of violating Section 1 of the Sherman Act.


Perkins Coie counsel Henry Hauser said the Eleventh Circuit’s ruling is a victory for the Department of Justice's antitrust division, which submitted an amicus brief arguing that the district court had failed to analyse whether the Burger King franchisees had separate economic interests.
