Product Liability

Astrium, S.A.S. v. TRW Inc.

Successfully represented Corning Inc. against product liability and commercial claims arising out of the alleged degraded performance of six telecommunication satellites, with $135 million in damages claimed. Judgment in Corning Inc.'s favor affirmed by the Ninth Circuit. 254 F. Supp. 2d 1129 (C.D. Cal. 2003), aff'd, 197 F. App'x. 575 (9th Cir. 2006)

ICC – Paris

Successfully represented Boeing in a major satellite arbitration before the ICC in Paris. The ICC Tribunal rejected the satellite insurers' claims and awarded Boeing full costs.

Boeing v. Iran

Successfully represented Boeing in breach of contract claims through trial and appeal in U.S. court and German courts and foreign enforcement of judgment before the Iran-U.S. Claims Tribunal.

Gambra v. International Lease Finance Company, et al.

Defending aircraft manufacturer in litigation arising out of crash of Flash Airlines Flight 604 off the coast of Egypt. Successfully obtained forum non conveniens dismissal of all U.S. litigation 377 F. Supp. 2d 810 (C.D. Cal. 2005). France’s highest court, the Cour de Cassation, ruled in client’s favor on a critical jurisdictional issue. Case currently pending before the Tribunal de Grande Instance in Bobigny, France.

Isuzu Class Actions

Represented Isuzu in numerous class actions involving motor vehicles in Washington, Pennsylvania, Texas, New Mexico, Florida and California.

Richardson v. Genie Industries

Defense verdict for Genie in Florida; wrongful death product liability (aerial lift) claim.

Rondy's Inc. v. Tractor & Equipment Company

Affirmance of summary judgment dismissing gross negligence and fraudulent concealment claims arising from fishing vessel engine failure, and enforcing warranty disclaimers and damages exclusions in maritime vessel repair contract. 81 F. App'x. 658 (9th Cir. 2003)

Underwriters for Thuraya v. Boeing Satellite Systems International Inc.

Represented Boeing in international arbitration venued in Paris relating to satellite constructive total loss resulting in alleged damages of several hundred million dollars. The ICC issued a final decision rejecting insurers’ claims and awarding defense costs to Boeing.
