Hayden Schottlaender represents technology companies in litigation across the country, with a focus on class-action matters involving biometrics and privacy issues.
As a member of the firm’s Privacy Class Action Defense practice, Hayden routinely defends companies from claims arising under state and federal privacy laws, including the Illinois Biometric Information Privacy Act (BIPA). He has represented technology clients through all stages of litigation, including predispute investigations and communications, discovery, briefing and arguing dispositive motions, trials, and appeals. Hayden enjoys working closely with engineers and creators to fully understand litigated products and develop defenses.
Hayden also frequently litigates privacy and free speech issues associated with electronic communications and online activity, representing the largest platforms on the internet. He advises on content moderation policies and decisions and has litigated several cases throughout the United States involving Section 230 of the Communications Decency Act (CDA). Hayden also frequently counsels on providers’ compliance with the Stored Communications Act (SCA) and the Electronic Communications Privacy Act (ECPA). He helps navigate digital search, seizure, and disclosure issues that arise in response to requests by civil litigants and law enforcement.
Hayden benefits from his experience advising online platforms as both outside and in-house counsel. He previously spent two years on full-time loan to Twitter, where he worked in both its Safety, Content, and Law Enforcement (SCALE) and Litigation divisions. While at Twitter, Hayden advised the company on its legal obligations and rights in responding to demands from government entities around the world. He also managed a broad docket of cases on behalf of the platform, including advertiser class actions, copyright claims, third-party subpoenas, and litigation surrounding content moderation decisions.
