Overview

Ariel Glickman defends and counsels clients on issues concerning user privacy, online communications, governmental surveillance and criminal investigations, and free speech and expression.  

Ariel represents communications providers and online platforms in civil and criminal cases involving the Stored Communications Act (SCA), including those concerning data disclosure demands from private parties and the U.S. government. She also handles matters implicating Section 230 of the Communications Decency Act (CDA), the First Amendment, and state defamation and invasion of privacy claims. She has briefed these issues in state and federal courts across the country, and has successfully quashed subpoenas, warrants, and gag orders; vacated court orders; and opposed motions requesting user data. Ariel has similarly argued on behalf of her clients to dismiss cases, including where plaintiffs have sought injunctions against them.

Ariel’s extensive experience also includes counseling clients on the above statutes and related constitutional issues, as well as the Wiretap Act, Pen Register/Trap and Trace Act, the California Invasion of Privacy Act (CIPA), and other related state laws. She regularly advises on product development, policies, and practices related to wiretapping laws. During a recent secondment as security counsel at a technology company, she liaised with engineers, product, policy, law enforcement response, and integrity teams to provide strategic legal guidance on end-to-end encryption, wiretapping laws, and data disclosure.

Ariel has further represented clients related to government investigations and inquiries conducted by the U.S. Department of Justice (DOJ), U.S. Securities and Exchange Commission (SEC), and U.S. Federal Trade Commission (FTC), and has prepared witnesses for both grand jury and trial testimony.

Maintaining a robust and diverse pro bono docket, Ariel recently secured a fraud waiver for clients who were in removal proceedings to be deported, thereby providing a path for their citizenship. She obtained a civil protection order on behalf of a minor, enabling the minor to avoid testifying and confronting her abuser at trial; and negotiated an agreement between a father and mother as guardian ad litem for their child, resulting in the avoidance of a trial for the child. She is currently representing a client related to the violation of his civil rights under 42 U.S.C. § 1983, stemming from assault and battery on his person.

Prior to joining Perkins Coie, Ariel clerked for the Hon. Michael S. Nachmanoff of the U.S. District Court for the Eastern District of Virginia, where she assisted with high-stakes litigation by resolving a series of discovery motions and cross-motions for summary judgment involving nuanced legal issues. She is also a former Ethics in Excellence & Journalism legal fellow for the Reporters Committee for Freedom of the Press, where she represented the interests of journalists, drafting amicus curiae briefs related to the First Amendment and the CDA.

While at The George Washington University Law School, Ariel served as a legal privacy intern for the U.S. Office of Management and Budget, conducting an audit of a federal agency privacy and security program, and helped develop metrics for the success of the program. She also served as an assistant to Professor Daniel J. Solove, for whom she conducted research relating to international, education, and media privacy.
