In a published opinion, the court held that client’s default interest rate was neither an unenforceable penalty nor a liquidated damages provision, as it varied the performance required in the event of default, and, even if deemed a liquidated damages provision, it was not unreasonable. The decision ultimately resulted in dismissal of the case, followed by a non-judicial foreclosure sale of lender’s collateral.
