Perkins Coie’s National Security practice is led by former government officials with over 25 years of experience managing a wide variety of sensitive and sophisticated matters, including counterespionage, counterterrorism, protection of critical infrastructure and cyberspace, and other domestic threats.

Our attorneys have current TS/SCI clearances (with polygraph) and bring deep prior experience and insider knowledge to the problems they address.

The portfolio of national security-related work we undertake includes:

  • Providing comprehensive counseling on all facets of nation-state cybersecurity threats, including prevention and readiness, intrusion response, and remediation/hardening
  • Assist companies in establishing subsidiaries to work with U.S. national security departments and agencies and mitigate any Foreign Ownership, Control, or Influence (FOCI)
  • Advising on compliance with government surveillance requests under various legal authorities, including the Foreign Intelligence Surveillance Act (FISA)
  • Counseling on contracting and other business relationships with components of the U.S. intelligence community
  • Representing clients before the Committee on Foreign Investment in the United States (CFIUS) and undertaking other mitigation regarding foreign-based investments in, or other potential threats to, U.S. infrastructure
  • Defending and representing clients as targets and witnesses in counterintelligence, criminal, and inspector general investigations before various components of the U.S. intelligence community
  • Providing testimony (in open and classified hearings) to the U.S. Senate Select Committee on Intelligence (SSCI) and the U.S. House Permanent Select Committee on Intelligence (HPSCI), and advising clients who are doing the same
  • Assisting companies with compliance and government investigations regarding U.S. export control laws (such as the International Traffic in Arms Regulations (ITAR)), and economic and trade sanctions programs (such as those enforced by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC))
  • Working on behalf of clients with Five Eyes agencies, such as GCHQ (UK) and the Australian Signals Directorate (ASD)
  • Counseling on proposed changes to U.S. legislation potentially affecting U.S. national security issues
  • Remediating challenges involving personal and corporate (facilities) clearances
