    A number of excess insurance companies argue that any compromise between the policyholder and an underlying carrier should result in the policyholder losing all excess coverage. It's time for policyholders and their brokers to just say no to wordings in their policies that may yield such an inequitable result.

    The panel will encourage all parties to support the proposition that excess coverage is triggered by the amount of the liability, rather than who will be responsible for payment. Such an approach will not only reduce litigation, but foster better relationships, compromise and stability among policyholders, underlying and excess insurers.
