Jason Howell serves as co-chair of the Advertising, Marketing & Promotions practice and as a member of the Trademark, Copyright & Media practice. Jason counsels clients on marketing, advertising, brand and consumer protection, and regulatory compliance issues, such as advertising claims and substantiation, sale and discount advertising, marketing and sponsorship agreements, product launch and development, contests and sweepstakes, endorsements and influencers, and promotional offers. Jason also represents clients in trademark, false advertising and unfair competition disputes, and positions clients for success by auditing marketing assets and creating in-house marketing and advertising compliance programs. Advertising & Marketing Counseling
Jason regularly audits ad copy, marketing materials, websites, software apps and labeling for false advertising, claim substantiation, regulatory compliance, intellectual property infringement and right of privacy and publicity issues. He advises clients on how to comply with Federal Trade Commission rules and guidelines as well as on how to avoid consumer, competitor and regulator challenges associated with marketing campaigns.
Marketing Compliance
Jason works with technology and consumer products companies, including Fortune 50 brands, to prepare marketing compliance playbooks and setup compliance programs for in-house legal and marketing teams.
Promotions Counseling
A substantial area of Jason’s experience is in advising businesses on how to structure contests and sweepstakes for compliance with U.S. and international promotions. He also counsels brands on establishing promotional offers, sales and discounts that comply with state, federal and international laws.
Marketing & Media Transactions
Jason drafts and negotiates advertising, licensing, and technology agreements, including advertising and creative services agreements, sponsorship agreements, celebrity endorsement agreements, influencer agreements, co-marketing agreements, media releases, and trademark and content license agreements.
Trademark and Copyright Prosecution and Portfolio Management
As part of his comprehensive brand guidance, Jason manages U.S. and worldwide trademark and domain name portfolios, and counsels brands regarding trademark and copyright clearance, registration and protection. He also conducts due diligence reviews of trademarks, copyrights and domain names for major corporate transactions, including mergers and acquisitions.
