Erik has worked directly in client organizations through remote and on-site secondments, providing immediate legal support when needed and seamless interaction with outside counsel for more complex issues.

Advertising, Marketing, and Promotions

Erik counsels retail, technology, and other brands on a variety of marketing topics, including the following:

  • Federal, state, and local truth-in-advertising laws and regulations
  • Claim substantiation for advertising copy
  • Website content and product listings
  • Health and wellness claims
  • Product pricing
  • Recurring subscription programs
  • Loyalty and rewards programs
  • Contests and sweepstakes
  • Email and phone-based marketing campaigns
  • Influencer agreements and guidelines
  • Ad agency and media services agreements
  • Product end-of-life issues

Commercial Agreements

Erik drafts and negotiates commercial agreements and amendments on behalf of major technology companies, most notably contracts for professional services related to cloud computing platforms. He analyzes customer and subcontractor agreements for gaps in scope descriptions, risks related to work schedules, and opportunities to optimize fee structures. When a project is delayed or there is a change in scope, Erik effectively negotiates amendments or change orders to help minimize the impact on the client’s bottom line.

Dispute Resolution

Erik is skilled at analyzing data and providing factual analysis to effectively provide insights on litigation-specific issues, including on a variety of e-discovery platforms. He has experience identifying key documents for litigation preparation, reviewing for privilege, and evaluating documents in a variety of matters, including contract disputes, engineering and technical issues, intellectual property rights, and product liability.

Previous Experience

Prior to joining Perkins Coie, Erik advised on international corporate finance, shipping and marine insurance law, and construction law at law firms in New York, London, and Oslo. He also has experience working in-house at technology and engineering companies in the United Kingdom, Norway, and Sweden. Erik has drafted and negotiated complex commercial agreements, including supply chain, outsourcing, and licensing agreements; engineering, procurement, and construction (EPC) and other large-scale construction contracts; vessel charterparties; issuance of corporate equity and debt; and financial derivatives. His work has also included preparing investor communications and regulatory submissions, developing contract management strategies for supply chains, performing risk assessments, and training employees on legal issues and risk mitigation.
