Media, Newspaper, and Delivery Transportation Clients

Represent various media and transportation/delivery clients in class action lawsuits based on claims of misclassification of contractors under agreements to effect delivery of goods and services.

Salgado v. The Daily Breeze, et. al.

Won class-wide summary judgment finding independent contractor status for all class members. Trial court denied certification on the wage-and-hour Labor Code claims, resulting in limited claims for expense reimbursement, record keeping, and unfair business practices section 17200, on which final Judgment was entered for defendants.

Newspaper Publishing Company

Obtained a full reversal of an adverse audit finding by the EDD regarding independent contractor classification.

T-Mobile USA, Inc.

Represented T-Mobile regarding claims filed with the California Labor Commissioner.

Salazar v. Redbox Automated Retail, LLC, et al.

Defended Redbox in consumer protection class action alleging violations of the California Gift Card Act.

National Mortgage Company

Initiated lawsuit against former employee for misappropriation of trade secrets, conversion and Penal Code 502 violation, related to unlawful access to information of mortgage loan provider, in San Diego Superior Court. As a result of Summary Judgment Motions filed on complaint and cross-complaint, the matter resulted in dismissal of the entire action on terms favorable to the client, including dismissal of employee’s whistleblowing claim against client.

National Logistics Company

Successfully obtained dismissal of California civil action for wrongful termination and discrimination based on enforcement of Illinois forum selection clause in employment agreement.
