Antitrust Second Request

Leveraging advanced analytics technology, the ESS team consulted with Perkins Coie attorneys to create a prioritized review of one million documents in two months in response to a request for information by the U.S. Department of Justice, Antitrust Division. We assisted in selecting the technology, developing the review process and overseeing the execution of the review. Leveraging leading-edge technology was critical to not only meeting the tight timeline of this multiple language project but to conserving significant client cost in the process. An extensive review for personal identifying information was also completed.

Arbitration Preparation and Support

ESS management proposed cost-effective technology and consulting solutions to strategically reduce and review more than 200 gigabytes of collected data in an arbitration matter. Working within a one-month timeframe, the ESS project management team effectively structured the review, employing email threading to reduce data and analytics to prioritize data for review. ESS Project Managers managed a team of 25 Discovery Attorneys to complete review of our client’s data. The ESS analyst team performed quality control of productions using in-house technology. In preparation for arbitration, the ESS trial support team consulted on and developed demonstratives and presentation methods to deliver graphic representations for issue resolution. The ESS trial support team also helped present during the mock arbitration. During arbitration, ESS coordinated on-site management of trial technology and worked alongside the case team throughout the entire arbitration, employing multiple presentation tools to display exhibits and presentations and highlight key exhibit segments. In addition, ESS set up the arbitration room as agreed upon by the parties and facilitated simultaneous document feed for tribunal members and witnesses.

Foreign Language Reviews

Our ESS professionals provide foreign language review in multiple languages structured to meet particular matter requirements. In a recent patent litigation matter, we designed a foreign language review workflow to target documents requiring translation. Within two months, 18 discovery attorneys located in New York and Seattle reviewed technical documents and documents with limited searchability in English and Chinese. In a separate intellectual property dispute matter, we managed foreign language review in which three discovery attorneys reviewed documents in Chinese and Spanish in several weeks. The ESS team managed discovery attorneys providing foreign language review of non-technical documents in Chinese and Japanese for an antitrust matter spanning more than one year. In addition to providing English translation, discovery attorneys were available to complete priority projects.

Strategic Technology and Workflow in Litigation Projects

The ESS team proposed and implemented advanced technology workflow solutions that saved more than $3 million in a large-scale litigation data review matter. Integral in the selection of technology, the ESS team paired cost-effective culling technology with state-of-the-art data management and review technology, resulting in strategic data reduction and an efficient review process. The ESS project management team managed a team of 14 ESS discovery attorneys, who completed their review in half as much time as would have otherwise taken.

Environmental Administrative Records Matters

In several environmental administrative matters, ESS professionals assisted in the selection and use of particular technology that allowed the case teams to efficiently organize their data. Approaches included such options as creating custom chronological reports with hyperlinked documents and creating best-practice workflows for complex searches to ensure streamlined and efficient analysis of the information. The net result is that the case teams were more efficient and more effective.

Data Security Breach

An ESS team consulted with Perkins Coie attorneys and a major international client to identify the scope, and assist in its reaction to, a data security breach. ESS paired predictive coding with its own technical experience to prioritize data for review, locate personal identifying information with customized categorization and design a custom export workflow for breach notifications. Strategic use of technology allowed for efficient location of specific types of personal identifying information such as names and social security numbers.
