We regularly counsel clients on all phases of IP enforcement, helping them to identify, analyze, and resolve issues efficiently by prioritizing targets and addressing them through cease and desist programs, litigation or other means. Where appropriate, we prepare referrals of cases to U.S. and foreign law enforcement. Our team of attorneys includes former prosecutors from U.S. Attorneys’ offices and the Department of Justice’s Computer Crime & Intellectual Property Section.

Perkins Coie has established enforcement programs to address individual, multi-state and multi-country copyright and trademark issues, as well as network and platform security issues. These enforcement programs have covered a wide variety of goods and services.

Representative examples include:

  •  We are national anti-piracy counsel for Microsoft Corporation, bringing cases against makers and distributors of counterfeit and infringing software.
  •  We work with Facebook to develop and implement an enforcement program to address spam, phishing and other threats to its systems and users which has been highly effective.
  • We developed and launched an enforcement campaign (investigation, cease and desist, and litigation) for another major company to counter abuses of its services and users through spam, phishing, fraud and other illicit activity. A component of this campaign included enforcement against developers and providers of the software and services that facilitated the illicit activity. The complaints adopted novel legal theories of copyright infringement and violations of the Digital Millennium Copyright Act (DMCA).
  • We also regularly monitor for domain name infringements for a plethora of clients. When necessary, we have successfully litigated many of these cases in court or through arbitration.
