    Bill Malley Quoted on ARPA-E Application Process

    Perkins Coie Partner Bill Malley commented on the DOE's ARPA-E application process in a recent Environment & Energy Daily article. The first step in the application process is to submit a five-page concept paper, which requires applicants to generally outline their projects. During the first round of funding, DOE received more than 3,600 concept papers and whittled that number down to about 300 projects that were asked to submit more detailed proposals. From that pool, DOE chose the first 37 winners. The entire process occurred in just a few months. "We don't know how fast the next round will go, but we assume it's on a similar schedule," said Malley, who has represented clients that have applied for ARPA-E grants. "This stands out as a fast track."

    Perkins Coie Partner Jeffrey Hunter was quoted in an article published by Inside Counsel entitled "Powering Down." The article discussed the large amount of CO2 backup generators can emit from datacenters because of their need for uninterrupted power. But when building datacenter facilities, many companies overlook these potential outbursts of pollution and improperly site the crucial generators, said Hunter. "Emergency generators don't have pollution control equipment," he says. "It's not like your typical power plant that's running 24/7 and is a Title V source putting in all these controls."

Factored into this decision was the requirement that federally funded construction projects must undergo a major environmental review. Partner Bill Malley commented on this review, which can take two years or longer, in a recent Dallas Morning News article entitled, "Texas utilities' rejection of stimulus funds could lead to higher bills for customers." "I think what many applicants are finding is it's very difficult to come up with a project that does meet all of [the stimulus' required] parameters," said Malley.
