Perkins Coie Partner David Biderman was quoted in a Law360 article titled, "Dukes, Comcast Thwarting Cert. In Calif. Food Labeling Suits."  The article discusses how California federal courts are showing an increasing reluctance to certify classes of consumers who allege they were misled by food labels or advertisements, shooting down certification efforts in a series of recent rulings by relying on U.S. Supreme Court's pro-business decisions in various cases. On top of using Supreme Court precedent to reject food labeling and advertising certification bids, some California federal courts also are taking a hard look at the ability of plaintiffs to show an ascertainable class and have been applying the Third Circuit’s decision in Carrera v. Bayer Corp, according to Biderman.
