Perkins Coie Partner Janis Kestenbaum was quoted in a Law360 article titled, "FCC Could Face Tough Road To Barring Forced Arbitration." The article discusses how the Federal Communications Commission may have difficulty crafting a plan that would ban mandatory arbitration clauses in customer contracts that can withstand court review. “We’ve seen this commission has been very willing to push its authority to basically sort of the outer bounds,” Janis said. “I think we are seeing that with this arbitration provision, and how it plays out is anybody’s guess, but I think we’ll be seeing a lot of these arguments.”
