Program Summary:

While the ITC is a popular forum to litigate patent disputes because of its authority to exclude companies from importing products into the United States, the types of remedies and how to establish or defend against the remedies are changing. This program will provide an in depth look at cases at the ITC, who can file them, how they work, and why it is popular. Special focus on how remedies are changing from the prospective of the patent holder, the importer, and the implications on third parties. We will address issues such as what evidence a patent holder should present to get the most out of the remedy, how an importer and its business should prepare for a possible remedy against the importer, and how a remedial order from the ITC can effect an importer's suppliers and customers. Program will also provide a handout that you can use as a cheat sheet when handling ITC cases.
