The CFTC Amends Retail Forex Transaction Regulations

On Monday, September 12, 2011, the Commodity Futures Trading Commission (the “CFTC”) amended its regulations governing off-exchange foreign currency transactions with members of the retail public (“retail forex transactions”).  These amendments incorporate changes made to the Commodity Exchange Act (the “CEA”) by Title VII of the Dodd-Frank Wall Street Reform and Consumer Protection Act (the “Dodd-Frank Act”).  The CFTC is also issuing certain related technical interpretations of various provisions of the CEA as amended by the Dodd-Frank Act with respect to retail forex transactions.
