During the past six months, important developments in the field of employment law have taken place.  For example, the EEOC recently approved proposed regulations implementing the ADA Amendments Act of 2008, the first step toward providing new ADA guidelines for employers.  In addition, the U.S. Supreme Court's decision in a highly anticipated and controversial reverse discrimination case provided a new standard to guide employers and courts in discrimination cases.  We have also seen litigation in the wake of the Lilly Ledbetter Fair Pay Act of 2009, passed earlier this year, while Congress continues to move forward on the Employee Free Choice Act (EFCA).  In addition to these legal developments, the N1H1 virus has many employers concerned about how to manage a possible outbreak while complying with federal and state employment laws.
