Perkins Coie Partner Aaron Wininger was recently quoted in an article titled "Tort Law has an impact on IP matters" that appeared in the China Business Law Journal. The article discusses how the PRC Tort Law, which took effect on July 1st, 2010, has impacted intellectual property law, and how China's amended IP law will effect employers. Under the amended law, companies must pay employees compensation for inventions, either a default amount or one agreed upon by the employer and employee. "Besides the complexity in calculating what this royalty is, the default rule could lead to huge damages awards against employers," Wininger was noted as saying.
