Overview

Businesses across the country regularly face the loss of employees to a job-related injury or disease. Commonly, injured workers need time off from work or a job modification. Each state requires by law that the employees be paid lost-time compensation. While most workers’ compensation claims are valid, ineffective claims management and fraud cost employers tens of millions of dollars annually.

Our Workers’ Compensation practice has broad experience in dealing with complex legal and medical issues. Our clients include companies that are self-insured, members of retrospective rating plans and those insured through the standard state fund program. We work directly with claims managers to achieve cost-effective claim outcomes. In addition, we have extensive experience in litigation in administrative proceedings as well as trial and appellate courts. Our attorneys understand that workers' compensation claims impact our clients’ businesses through lost employee productivity, the cost of claims and the risk of litigation. We work with clients to take preventive measures, helping to develop safety programs and advising on how state or federal regulations will impact their businesses.

When claims are filed, we advise clients on issues related to length of disability, return-to-work arrangements and vocational benefits. We also are experienced with working with experts to research medical issues and pre-existing conditions. We also work closely with the attorneys in our Labor & Employment practice to coordinate advice and representation for employers facing multiple employment-related claims from individual workers.
