Timothy L. Alger

Timothy Alger, a partner in the Litigation practice, represents a variety of technology and media companies in intellectual property and free speech matters. An experienced business litigator, he has defended many of the nation's largest news media, Internet and entertainment industry companies against claims for defamation, invasion of privacy, trademark and copyright infringement, unfair business practices, and breach of contract. He has also represented news media clients in litigation seeking access to public records and government proceedings.

Prior to joining the firm, Tim served as Deputy General Counsel at Google, where he supervised the Litigation, Employment and Trademark groups. During his tenure, these groups experienced several major victories, including winning a summary judgment in the Viacom/YouTube copyright litigation, a summary judgment in the Rosetta Stone trademark keyword litigation and two patent jury trials in the Eastern District of Texas.

In 2003, Tim obtained a watershed ruling from the Ninth Circuit Court of Appeals under the Communications Decency Act in Carafano v. Inc. The court adopted a broad view of the statute, holding that interactive computer services are immune from liability for user content even if they format and use automated tools for the postings.

Tim has spoken frequently on issues such as privacy, copyright fair use, the Digital Millennium Copyright Act, defamation, the right of publicity and the Communications Decency Act.
