Represented patent-holder VISICU against accused infringer of VISICU’s patents relating to systems and methods for providing expert care to hospitalized patients from remote locations. Case currently on appeal to the Federal Circuit.

U.S. District Court for the Eastern District of Pennsylvania

Represented patent-holder VISICU against accused infringers of VISICU’s patents relating to systems and methods for providing expert care to hospitalized patients from remote locations.

U.S. District Court for the Southern District of New York

Defending Mylan in bench trial regarding infringement, enforceability, and validity of patents relating to a treatment for multiple sclerosis. Outcome is pending. No. 09-CV-8824

U.S. District Court for the Western District of Wisconsin

Represent real estate institution in patent infringement case regarding iPhone and Android applications (apps); obtained summary judgment and sanctions awards for client.

U.S. District Court for the Western District of Washington

Represented the University in the enforcement of patent relating to medical imaging.

U.S. District Court for the Northern District of California

Represented MTI and ev3 in an infringement action on the University of California’s patent for an endovascularly inserted detachable coil for the treatment of brain aneurysms. The case settled on the eve of trial.

U.S. District Court for the Western District of Wisconsin

Obtained summary judgment of noninfringement on wind turbine control system patents.

U.S. District Court for the Southern District of New York

Represented Philip Morris in trademark litigation to stop distribution of counterfeit cigarettes.

U.S. District Court for the Southern District of New York

Defended Mylan and Natco in suit alleging infringement of multiple patents related to polypeptide markers for measuring the molecular weight characteristics of a pharmaceutical composition for the treatment of multiple sclerosis.  Mylan obtained dismissal of suit in its entirety for failure to state a claim upon which relief could be granted.

Intellectual Property Litigation
U.S. District Court for the District of New Jersey

Represented Texas Instruments in patent infringement/antitrust action, including assisting in defending against antitrust claims and dismissal of per se tying claims and monopolization claims.

U.S. District Court for the Western District of Wisconsin

Represented Encyclopedia Britannica in patent litigation involving GPS mapping device technology.

U.S. District Court for the Eastern District of Texas

Defended Chinese telecommunications company in preliminary injunction hearing and subsequent litigation regarding computer router technology.  Matter resolved after motions practice.

Superior Court of Massachusetts

Represented inventors in dispute with former employer over ownership of breakthrough cloning technologies.

U.S. District Court for the Eastern District of Wisconsin

Represented Succeed Management Solutions in case involving allegations of trade secret misappropriation, copyright infringement and unfair competition.  Matter resolved through mediated settlement.

Antitrust & Unfair Competition Litigation

Represented Microsoft Corp. in a number of antitrust actions brought by indirect purchasers and competitors in state and federal courts across the country. Took to trial antitrust class action in Iowa state court, which ended in settlement. Defeated efforts to impose liability through collateral estoppel.

U.S. District Court for the Eastern District of Texas

Represented Qualcomm in an antitrust suit involving allegations of misconduct before a Standard Setting Organization. Obtained summary judgment dismissing group boycott antitrust claims.

Represented Visa against indirect purchaser actions filed in state courts across the country. Visa’s motion to dismiss on antitrust standing and venue grounds granted.

U.S. District Court for the Western District of Wisconsin

Represented Kohler in patent and antitrust litigation regarding riding lawn mower engine technology.

U.S. District Court for the Western District of Wisconsin

Representing Baker Tilly, a national accounting firm, in insurance recovery action against its insurer. Outcome is pending. No. 12-CV-381

U.S. District Court for the District of New Jersey

Representing Mylan Inc. in litigation involving breach of a patent settlement agreement.

Superior Court of Wisconsin

Represented domestic and international clients with interests in the rehabilitation of the Ambac Segregated Account.

U.S. District Court for the Western District of Wisconsin, U.S. Court of Appeals for the Seventh Circuit

Represented Ms. Rivers and a group of defendants in litigation involving invasion of privacy claims related to the film Joan Rivers: A Piece of Work. A dismissal order in favor of the defendants in the district court was affirmed by the Seventh Circuit Court of Appeals.

Represented Mylan in action brought by Wisconsin challenging prescription drug reimbursements.

U.S. District Court for the Western District of Wisconsin

Representing inmate in claims involving deliberate indifference to his dental care needs.

U.S. District Court for the Middle District of Georgia

Representing death row inmate in appeal of lethal-injection sentence.

U.S. District Court for the Eastern District of Wisconsin

Appointed to represent plaintiff in a civil suit against law enforcement officers for excessive force and deliberate indifference.

Drafted Amicus Brief for Civil Rights and other civil rights organizations.

Represent prison inmate in Eighth Amendment claims for failure to protect from self-harm and denial of adequate mental health care.
