Obtained district court injunction on behalf of a nationwide class, preventing the government from removing over 3,000 individuals to Somalia. The Ninth Circuit affirmed, rejecting the contrary view of the Eighth Circuit. Filed amicus on behalf of client in the Supreme Court's consideration of the circuit split in Jama v. ICE, 543 U.S. 335 (2005). After the Supreme Court upheld the Eighth Circuit's decision by a 5-4 vote, the Ninth Circuit vacated the injunction in this case. 213 F.R.D. 390 (W.D. Environmental litigation (forest products industry): Obtained summary judgment on NEPA and Federal Land Policy and Management Act (FLPMA) claims which allowed Crown Pacific to proceed with 70,000-acre land exchange with United States.

Represented Weyerhaeuser Company in a variety of matters for both operating and closing facilities, including NPDES and Special Use permits; regulatory compliance issues; stormwater, NEPA and ESA issues; defense of CWA litigation; legislative drafting; Title V CAA permitting; PSD/NSR enforcement defense; water supply; and real estate due diligence.  This included assisting in the demolition of a major pulp and paper facility and a very large wood products facility, and the following sale of both industrial sites.

Assist barge building and ship repair/dismantling clients in investigation and successful remediation of Portland South Waterfront industrial site uplands and sediments (including excavation and capping) as area converts to commercial and residential uses.  This involved every aspect of RI/FS, RD/RA, consent judgment and all related permitting, including stormwater and ACOE permits. (Site was former shipbuilding and ship deconstruction facility.)
