Perkins Coie attorneys Barry Reingold, Ryan Mrazik and Miriam D'Jaen have written "Cloud Computing: Whose Law Governs the Cloud?" as the last of a three-part series looking at cloud computing from market and legal perspectives. Part I, "Cloud Computing: The Intersection of Massive Scalability, Data Security and Privacy," and part II, "Cloud Computing: Industry and Government Develoments," examine the capabilities of cloud computing, the associated privacy and data security concerns, and industry and policy developments. Part III focuses on key legal issues that will shape cloud computing: Whose law governs the cloud, especially if there is a security breach? Who has possession, custody or control over data in the cloud? Finally, how will courts resolve conflicts of law between overlapping jurisdictional claims?
