Seventh Circuit Court of Appeals Judge Richard Posner (joined by Judges Tinder and Hamilton) repeatedly cited partner T. Markus Funk’s book (Child Exploitation and Trafficking: Examining the Global Challenges and U.S. Responses; co-authored with US District Judge Virginia Kendall) as authority for the use and effectiveness of computer encryption and the presence of files on hard drives even after a user “deletes” them. See United States v. Seiver, 11-3716 (7th Cir. 2012). Funk is part of the firm’s Investigations and White Collar Defense Group, which regularly handles internal investigations involving data stored on computers, as well as the use of computer encryption.
