This experience also assists us in providing prepublication review and counseling to media clients on how to minimize the risks of litigation. For more than 25 years, we have assisted media clients in obtaining informational from governmental entities, and, when necessary, prosecuted actions under the federal and state information access laws. We routinely represent media clients in responding to third party subpoenas and protecting confidential sources.
Libel & Privacy
We have represented newspapers, broadcasters and credit reporting agencies in defamation and invasion of privacy actions in state and federal courts throughout the country. We are often able to achieve early resolution through dispositive motions or summary judgment. When necessary, we can rely on our significant trial experience to help clients through litigation.
Access to Information
We advise clients on how to obtain access to the records and proceedings of governmental agencies and the courts. In Arizona, the firm operates a 24-hour media hotline for all print and broadcast reporters and editors in the state. The hotline provides advice concerning access to public records, open meetings, court proceedings and cameras in the courtroom.
We defend media clients against subpoenas for their testimony, notes and video in criminal and civil matters and have been successful in getting many such subpoenas quashed or withdrawn. We have litigated matters that established the reporter's privilege in Washington and defined the privilege in Arizona and in the Ninth Circuit.
