Kelly Moser is an associate in the firm's Environment, Energy & Resources group. Kelly focuses her practice on environmental and natural resources counseling and litigation. She assists clients with compliance and regulatory matters under state and federal land use and environmental statutes, including the Clean Water Act (CWA); the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA); and the Model Toxics Control Act (MTCA). She also represents clients in a variety of environmental litigation matters, including CERCLA and MTCA actions, natural resource damage claims, and government enforcement actions. Kelly's practice also focuses on energy project development and facility siting. She has assisted clients in the development of energy facilities, including wind power projects.
As a trial attorney with the United States Department of Justice, Kelly represented the United States in its trust capacity for Indian tribes in suits establishing water rights in the Klamath River Basin, establishing and protecting hunting and fishing rights, and establishing reservation boundaries.
